What am I Facing If I am Charged with Robbery in NJ?

If you've been charged with robbery, the consequences that you're facing are extremely serious. We have basically two types of robberies in New Jersey. We have one that is considered a first-degree armed robbery where you would be facing between 10 and 20 years in state prison. You would have to serve 85% of whatever sentence you got before you are eligible for parole. That is subject to the No Early Release Act.

So that would be a case if you are charged with pointing a weapon at somebody, or you're armed with some type of weapon, or you are threatening that you have a weapon. Those would be a first-degree robbery. We then have what are considered second-degree robberies, which would be without a weapon. I mean, another term for that would be a strong-arm robbery. So essentially, that is a second-degree offense where you face between 5 and 10 years in state prison.

That is also subject to the No Early Release Act, so you would have to serve 85% of whatever sentence you receive if you are convicted or plead guilty to that charge.
