Being charged with possessing a handgun in New Jersey is an extremely serious offense. It is a second-degree offense where you are facing a mandatory 5 to 10 years in prison if you are found guilty or plead guilty to that charge. Even more serious is the fact that you are subject to the Graves Act, which is a period of parole ineligibility. For that offense. So basically what that means is you are looking at a minimum of 5 years in New Jersey State Prison with 3 years of parole ineligibility. That can be lowered to a 1-year period of parole ineligibility with permission, obviously, of the Prosecutor's Office and of the Assignment Judge.
