Client Facing Graves Act Prison Sentence for Handgun Charges Accepted Into PTI

State v. EA (2022)

Charged with 2 Counts of Unlawful Possession of a Handgun, 2nd degree offenses; and 2 Counts of Prohibited Weapons (large capacity magazines), 4th degree offenses.

EA was found to be in possession of 2 disassembled handguns and 2 large capacity of magazines at the airport after flying into New Jersey.  Parts of the guns were found in checked luggage and parts were found in carry-on luggage.  EA was facing 5-10 years in State Prison subject to the Graves Act (mandatory minimum of 42 months) on both gun charges.  After negotiations and an extensive mitigating package provided to the assistant prosecutor, EA was approved and admitted into the Pre-trial Intervention Program (PTI).
