Client Avoids 25 Years to Life on Aggravated Sexual Assault Indictment and Receives Probation

State v. JPV (2021)

Indicted for Aggravated Sexual Assault, 1st degree offense; Sexual Assault, 2nd degree; Endangering the Welfare of a Child, 3rd degree.

Initial pre-indictment offer was for 5 years in State Prison, subject to the No Early Release Act (must serve 85% of the sentence before being eligible for parole). This was immediately rejected.  After indictment, JPV was facing a mandatory minimum sentence of 25 years to life on the 1st degree aggravated sexual assault as it was subject to the Lundsford Act.  After extensive investigation and negotiation, JPV plead guilty to a non-sexual offense and received non-custodial probation.
