2nd Degree Official Misconduct Charges Downgraded to 3rd Degree Theft

State v. WG (2023)

Charged with Official Misconduct, a 2nd degree offense; Theft, a 3rd degree offense; and Credit Card Theft, a 4th degree offense.

WG was facing a mandatory State Prison Sentence of between 5 and 10 years for official misconduct. 

After a lengthy negotiation, WG plead guilty to a 3rd degree Theft in exchange for a recommended sentence of probation conditioned on 364 days in the county jail.  All remaining charges were dismissed.  Prior to sentencing, Jason A. Volet filed a mitigation package on behalf of WG.  At sentencing, based on this information, the judge lowered the county sentence to 180 days
