I’ve Been Charged with a Disorderly Persons Drug Charge, Am I Eligible for a Conditional Discharge?

Many clients or potential clients come into my office having been charged with a disorderly persons drug offense. That could range from possession of less than 50 grams of marijuana, possession of paraphernalia like rolling papers or the baggies used to hold, to hold those drugs, or they could be charged with failure to turn over those drugs to a law enforcement officer. All of those are disorderly persons offenses. That person may be eligible for conditional discharge. If they have no prior drug arrests either in New Jersey or in any other state in the country.
